An individual assessment
Discuss whether you can pursue factory accident claims
Factory claims can involve machinery, production lines, maintenance, vehicle movements and manual tasks. An effective assessment starts with the task being performed when the injury occurred, including whether normal operation, cleaning or fault clearance was underway. AJS can consider employer and contractor roles, instructions and available evidence alongside the injury's consequences. Contact the firm to discuss the investigation required and the basis on which representation might be offered.

What needs to be established
Factory incidents may occur during ordinary production, a product changeover, clearing a blockage, cleaning or maintenance. The same machine can present different risks at each stage. Record the machine identifier, task, guards and controls involved, and whether a colleague operated another part of the line. Avoid assuming a visible emergency-stop button answers whether the overall system was safe for the work being done.
How this affects your enquiry
The assessment may consider training, supervision, isolation, guarding, maintenance and pressure to resume production. State what instructions you actually received and whether the normal method differed from a written procedure. If an agency supplied your labour, identify both the agency and host factory. Several organisations may have relevant information, but their involvement should not be converted into an unsupported allegation against each one.
Preserve the line configuration and employment evidence
What needs to be established
Keep the incident reference, shift details, photographs taken safely and names of people familiar with the task. A changed guard or repaired component should be recorded as a later alteration, not treated automatically as an admission. Production and maintenance records may need a formal request. Never restart or reach into machinery to collect evidence, even where you believe it has been isolated.
How this affects your enquiry
Explain the injury's effects on grip, dexterity, standing, shift work or concentration as applicable. Overtime and production bonuses require records; they should not be assumed to continue indefinitely. For a serious injury, ask how rehabilitation and future work capacity will be assessed before settlement. AJS can review the enquiry and proposed evidence without promising a particular compensation amount or return-to-work date.
Prepare for your factory accident claims discussion
Give a focused account of your circumstances
Identify the machine or production area, shift, supervisor and task. Preserve training, maintenance or reporting documents already lawfully available. Describe guards, isolation arrangements and emergency controls as observed, avoiding technical conclusions beyond your knowledge. Keep accident reports and treatment records, and explain overtime, shift premiums, rehabilitation needs and any proposed return-to-work changes.
Agree scope, costs and the next action
Discuss scope and funding before instruction. Read our costs information and ask which terms would apply to your case.
Factory accident claims: questions before instructing
Can I enquire if I was clearing a jam rather than operating the line?
Yes. Explain the clearing method, instructions and machine state. A maintenance or intervention task may require different precautions from routine operation. Describe what normally happened on the line and what was different on the incident date.
What if the employer says I bypassed a guard?
Disclose the allegation and give your own accurate account. The investigation may examine the guard, training, supervision and working practices, as well as your actions. Do not alter your description to fit a procedure you did not follow.
Why distinguish production from maintenance work?
Different controls and instructions may apply when machinery is running normally, being cleaned or being repaired.
What if a machine guard was removed?
Describe who removed it, why and the instructions given; preserve relevant reports without interfering with equipment.
Can an agency factory worker enquire?
Yes. Identify the agency and factory operator and explain who supervised the task and supplied training.
Does signing a training sheet prove adequate training?
It records a step but does not settle whether instruction addressed the actual task and risk.
What if the production line restarted unexpectedly?
Record the sequence, operators and isolation arrangements, including any investigation already underway.
Should I collect internal maintenance records?
Preserve copies lawfully held; do not access restricted systems or remove confidential company records.
Can a factory vehicle collision be assessed?
Identify the vehicle, pedestrian route, visibility and segregation arrangements at the incident location.
What if a hand injury affects precision work?
Describe actual tasks, dexterity limits and adjustments so functional and earnings consequences can be assessed.
Are overtime losses relevant?
Provide a reliable history and expected shifts, separating regular overtime from speculative opportunities.
Does a clean safety record defeat a claim?
It does not by itself resolve the particular incident, risk or precautions that were reasonable.
What if I was clearing a jam?
Explain the stoppage, instructions, tools and whether energy sources were isolated before the task.
Can hearing symptoms be included in an accident enquiry?
Describe whether they followed one event or prolonged exposure; the appropriate investigation may differ.
Should I keep damaged work clothing?
Retain items lawfully yours where safe, with photographs and the incident context.
What if colleagues fear giving evidence?
Provide contact details only with an appropriate basis and explain what each person actually observed; do not pressure witnesses.
Can outsourced cleaners injured in a factory enquire?
Yes. Clarify the cleaning contract, supervisor and control of the equipment or area involved.
What if I returned before full recovery?
Record restrictions, adjusted duties and subsequent symptoms accurately rather than presenting return as complete recovery.
Does a manufacturer's defect remove employer responsibility?
Potential responsibilities can overlap; the facts must establish each party's relevant role.
How can AJS assess a factory accident initially?
Provide the task, machine or area, working arrangement, injury and available investigation references.
